BHA members will no doubt be only too aware of the continued challenges that need to be overcome in order to trade successfully during the difficult economic climate which has worldwide implications.

The number of employment related issues raised by Bluefin clients is perhaps indicative of the fact that drastic action is being taken by companies to ensure their long term survival. This is however a complex situation and can lead to significant problems if incorrect procedures are applied.

It has been reported that a number of Legal Expenses Insurance providers have experienced significant increases in calls to their various helplines due to business struggling in the economic downturn. One insurer has reported a 190 per cent increase in calls for the first quarter of 2009 compared to the same period last year. Whilst the number of calls received from the SME Sector has increased from 1,982 to 5,697 an increase of 187 per cent.

Staff redundancy issues can be time consuming and very costly if not addressed in the correct manner with businesses sometimes failing to understand the need to consult and not pre-judge situations. This maybe particularly relevant if citing an individuals' "attitude" as a reason for taking action. This stance is highly subjective and is open to dispute.

Employment related legislation will be developing during this year. This includes such matters as the publication of the Equality Bill expected to become law in 2010, the Government announcement of an increase in the one-off statutory redundancy payments (proposed increase from £10,500 to £11,400 date to be announced) and new legislation to take effect on 1 October 2009 to prevent tips being used to top up wages to meet the national minimum wage (NMW). It is understood that further consultation will take place on a proposed new best practice guide on tipping.
