Resort operator fined after guest's death
Piperdam Golf and Leisure Resort near Dundee has been handed a £120,000 fine by Forfar Sheriff Court, following the death of a former guest in 2008.
The court found that the operator had breached health and safety legislation, which led to the death of Edward Warnes - a guest at the resort in March 2008. After feeling unwell upon his return to England, Mr Warnes died on 11 April 2008 after he was found to have contracted Legionnaires' disease.
An investigation by Angus Council detected traces of the same strain of legionella bacteria in the hot tub and two of the shower heads in which Mr Warnes had stayed. Elaine Taylor, head of the COPFS health and safety division, said: "The control measures which were in place at the Piperdam resort were inadequate and led to the proliferation of the legionella bacteria in the lodge where Mr Warnes and his family were staying."
