‘Loophole’ closed in Norwich
Nightclub operator, Luminar, has welcomed an appeal court judge’s decision to close a loophole that allowed café-bar operators obtain a special hours certificate (SPC) without clear proof that the sale of alcohol was ancillary to providing food and dancing.
In a decision, which has been described as landmark, Lord Justice Laws upheld the ruling that café-bars were not automatically entitled to open late, solely on the basis that they provide food and dance.
The appeal was lodged by Luminar, against an earlier ruling by Norwich Crown Court, which entitled a Lloyds No 1 establishment to a SPC.
Luminar claimed that café-bars should be forced to either reduce their trading hours, or bring their facilities in accordance with the SPC requirements.
